1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and BlusterTrek ("Company," "we," "our," or "us") regarding your use of our website blustertrek.com and our photography and personal branding services.

By accessing our website or using our services, you agree to be bound by these Terms. If you do not agree to all terms and conditions, you may not access the website or use our services.

2. Description of Services

BlusterTrek provides professional photography and personal branding services, including but not limited to:

• Corporate headshots and professional photography
• Personal branding photography sessions
• LinkedIn profile photography
• Team and group photography
• Image editing and retouching services
• Personal branding consultation

We reserve the right to modify, suspend, or discontinue any service at any time without notice.

3. Booking and Payment Terms

3.1 Booking Process

• All bookings must be confirmed in writing via email or our booking system
• A signed contract and deposit are required to secure your booking
• Booking confirmation is subject to photographer availability
• Special requests must be discussed and agreed upon before the session

3.2 Payment Terms

• A 50% deposit is required upon booking confirmation
• The remaining balance is due before delivery of final images
• Payments can be made via bank transfer, credit card, or approved payment methods
• All prices are in Singapore Dollars (SGD) and include applicable taxes
• Late payment may result in suspension of services and additional fees

3.3 Pricing

• Current pricing is available on our website and subject to change
• Quoted prices are valid for 30 days from the date of quotation
• Additional services or time beyond the agreed package will incur extra charges
• Travel fees may apply for locations outside Singapore's central area

4. Cancellation and Rescheduling

4.1 Client Cancellation

• Cancellations more than 48 hours before the session: 50% refund of deposit
• Cancellations within 48 hours: No refund of deposit
• No-shows: Full session fee due, no refund
• Weather-related cancellations for outdoor shoots may be rescheduled without penalty

4.2 Company Cancellation

• We may cancel due to illness, emergency, or circumstances beyond our control
• Full refund will be provided if we cannot reschedule within 30 days
• We will make reasonable efforts to provide alternative photographer

4.3 Rescheduling

• One free rescheduling allowed with 48+ hours notice
• Additional rescheduling may incur administrative fees
• Rescheduled sessions must occur within 90 days of original date

5. Image Rights and Usage

5.1 Copyright Ownership

• BlusterTrek retains copyright ownership of all images
• Clients receive usage rights as specified in the service agreement
• Images may not be resold, redistributed, or used for commercial purposes without written consent
• Copyright notice must remain on images when shared

5.2 Client Usage Rights

• Personal use: Social media, LinkedIn, personal websites, business cards
• Professional use: Company websites, marketing materials (with agreement)
• Clients may not alter, edit, or manipulate images without permission
• Mass distribution or publication requires additional licensing

5.3 BlusterTrek Usage Rights

• We reserve the right to use images for our portfolio and marketing
• Images may be used on our website, social media, and promotional materials
• Client names and identifiable information will only be used with explicit consent
• Clients may opt-out of promotional usage by written request

6. Delivery and Satisfaction

6.1 Image Delivery

• Standard delivery time: 48-72 hours for regular packages
• Rush delivery available for additional fee
• Images delivered via secure digital gallery
• High-resolution files provided in agreed formats (JPEG, PNG)
• Gallery access remains active for 90 days

6.2 Image Quality and Editing

• All delivered images include professional editing and color correction
• Basic retouching included: skin smoothing, blemish removal, color enhancement
• Advanced retouching available for additional fee
• We maintain creative control over editing style and final appearance

6.3 Satisfaction Guarantee

• We strive for 100% client satisfaction
• Minor edit requests accommodated within 7 days of delivery
• Reshoots considered on case-by-case basis for technical failures
• Subjective preferences (styling, posing) are not grounds for reshoot

7. Client Responsibilities

• Arrive on time and prepared for the session
• Follow agreed styling and wardrobe guidelines
• Provide accurate contact and booking information
• Inform us of any special requirements or medical conditions
• Respect our equipment and studio facilities
• Make payment according to agreed terms
• Obtain necessary permissions for minors or third parties

8. Limitation of Liability

To the maximum extent permitted by law:

• Our liability is limited to the amount paid for services
• We are not liable for indirect, consequential, or punitive damages
• We do not guarantee specific business outcomes from using our images
• Equipment failure or technical issues may affect service delivery
• Force majeure events (natural disasters, government restrictions) excuse performance
• Clients use our services at their own risk

9. Indemnification

You agree to indemnify and hold BlusterTrek harmless from any claims, damages, or expenses arising from:

• Your use of our services or images
• Violation of these Terms of Service
• Infringement of third-party rights
• Your negligent or wrongful conduct
• False or misleading information provided to us

10. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy, which is incorporated by reference into these Terms, describes how we collect, use, and protect your personal information. By using our services, you consent to our data practices as described in the Privacy Policy.

11. Intellectual Property

• Our website content, logos, and branding are protected by intellectual property laws
• You may not reproduce, distribute, or create derivative works without permission
• Trademarks and service marks remain property of their respective owners
• Client feedback and testimonials may be used for promotional purposes

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by Singapore law. Any disputes will be subject to the exclusive jurisdiction of Singapore courts.

12.2 Dispute Process

• Initial attempts to resolve disputes through direct communication
• Mediation through Singapore Mediation Centre if direct resolution fails
• Arbitration or court proceedings as last resort
• Prevailing party may recover reasonable attorney fees

13. General Provisions

13.1 Entire Agreement

These Terms, along with our Privacy Policy and any signed service agreements, constitute the entire agreement between you and BlusterTrek.

13.2 Amendments

We may update these Terms periodically. Continued use of our services after changes constitutes acceptance of updated Terms.

13.3 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force and effect.

13.4 Waiver

Our failure to enforce any right or provision does not constitute a waiver of such right or provision.
